I was injured in a work related incident on March 1St. 2005. The First aid report stated "Location point tender lateral abdomen."

I left work and went Newport Medical Clinic where I saw Dr. E. Ibrahim. In her report she stated "He was lifting heavy objects at work (Spindles). He complains of acute abdominal pain. Long scar seen on abdomen. Ventral hernia. Advised to go to hospital ERH. Abdomen, severe tenderness. Suspect Hernia or ruptured organ. Urgent ultrasound needed."

I then went to Eagle Ridge Hospital where I was diagnosed by Dr. J. Haegert with an abdominal wall strain. Dr. J. Haegert was an intern at the time, and told me I should be OK to return to work in a few days. (Although requested by Dr. E. Ibrahim, there was NO ultrasound performed at the hospital on that day.)

After a few days, and the pain had NOT subsided, I went back to see Dr. E. Ibrahim. She ordered me to have an Ultrasound done.

The next item in this series of events was when I filled out my WCB claim form. In it I said "Pain in abdomen."
You can see my claim form HERE

This claim was processed and accepted by WCB as claim # BB05122783.
.
On March 9Th. 2005, a memo from Harjit Hallate was forwarded to Kelly Norris (My Case worker). It stated “I am routing this claim to Entitlement Officer for ongoing management of wage loss payments. Employer is requesting the ultrasound be expedited”.
You can read the memo HERE

I saw Dr. E. Ibrahim on March 17Th. 2005 in a routine visit. In her report she said "Awaiting ultrasound report in about a week."

Dr. H. MacNaughton performed an ultrasound on March 26Th. 2005 at Tri City Radiology. In her report she stated, “The size of the defect in the abdominal wall is difficult to accurately measure but it is estimated to be at least 2.5 cm in diameter and the herniated Omentum and/or bowel measures 3 cm in diameter.”

This report was discounted by WCB.

I saw Dr. E. Ibrahim on March 31St. 2005 In her report she said "Recent ultrasound showed the hernia to be at least 2.5 cm in diameter and the herniated Omentum and/or bowel measures 3 cm in diameter.” She also said "It was recommended today that he be referred to a Surgeon"

In Dr. E. Ibrahim's report of April 26Th. 2005 she diagnoses "Upper quadrant abdominal hernia (Surgical)." A referral to Dr. N. Panton was arranged. Meanwhile NO lifting is allowed for this patient.

On May 17Th. 2005, Ms. Kelly Norris (Entitlement Officer) informed me that my claim had been disallowed because the Board Medical Advisor concluded that: -

We don't have to go any further than this point, all the necessary documentation is here. There is more documentation available.
I feel that neither My Case Manager Ms. Kelly Norris who thinks that a piece of my bowel was stitched into my stomach muscles (Which is scientifically incorrect), The BMA Dr. Biro who never examined me, nor did he pick up on the error in Ms. Kelly Norris's report, The WCB Appeals Dept. NOR the Vice Chair of WCAT (Who thinks that the abdomen is located in the chest) either read or understood Dr. H. MacNaughton’s report which you can read HERE

It should also be noted that WCB accepted Dr. J. Haegert's report not because it was accurate, but because they "PREFERRED" it to any other report.

Respectfully
